Burnett vs NAR Trial Update

Although this has been pending for some time, there has not been much to report, until now.  The trial is now underway and the MSBR Leadership wanted to share this information with the members.

Many REALTORS have been following the trial, and the opening arguments began last week. The plaintiffs are well on their way to presenting their case in the Burnett trial. NAR wants members to know what resources they have to stay informed.

The plaintiffs contend that commission rates are too high,  buyers agents are being paid too much, and that the Code of Ethics and MLS lead to price fixing.   NAR fundamentally disagrees and intends to prove that that NAR's rules and the MLS marketplace benefits consumers.

Updates can be found at www.nar.realtor/competition-in-real-estate.

In addition to updates, you will also find the NAR position. This site provides anecdotes of real people who've had real experiences with REALTORS® and how local MLS broker marketplaces work.  Traffic has been markedly up at the site and NAR encourages interested parties to keep looking there for quick facts, infographics, fact sheets, videos and other content they can refer to or distribute.

Check out realestatecommissionfacts.com, which is a good one-stop location to direct consumers or others for a better understanding about the basics of how compensation works.

Per NAR President Tracy Kasper: All these tools and information are great, but there's nothing more authentic and true to who you are as REALTORS® and all you do than the one-on-one experiences, connections and conversations each of you has with your clients where you can personally express your value as a REALTOR.  I appreciate all that each of you and all of our members do to represent REALTORS® each day. We know how much and how hard we're working for our clients every day, and I know that shows through.
